Terms of Service
Greetings, players,
These terms of service (the “Terms”) establish the terms and conditions under which GamesHyped offers access for you to use and enjoy our games, applications, websites, and other services (the “GamesHyped Services”). GamesHyped is a global video game company based in Brazil, with operations worldwide. When we say “GamesHyped,” we refer to the company responsible for providing the GamesHyped Services in your region (see Clause 19 below), and these Terms constitute an agreement between you and that company.
Please read these Terms carefully, paying particular attention to the following items:
- Virtual Content. When you click to purchase, earn, or receive Virtual Content, you only obtain a license to access the Virtual Content. You do not own any Virtual Content you unlock, and you cannot transfer it to anyone else. Virtual Content has no monetary value, is usually game-specific, and you cannot redeem it for any form of “real-world” money.
- Refund Policy. You lose the right to change your mind, cancel the order, and receive a refund if you have immediate access or download your digital content. There are some exceptions to this rule, but we have a strict refund policy. Learn more here.
- User Rules. You agree to follow our User Rules (Clause 7). These rules govern in-game behavior and certain conduct outside of the game while using the GamesHyped Services.
- Attention, Parents! We provide game age rating information on our website. We also recommend that you supervise your child's online activities, review the content they are accessing, and, if necessary, monitor their social interactions. For more information on age ratings and content descriptions, check your local rating system.
1. YOUR ACCOUNT
1.1. Can I create an account and use GamesHyped Services? (You need to be an adult or have permission from your parents or legal guardian.)
You will need a GamesHyped account to access many of our services. To create an account and use GamesHyped Services, you must: (i) be an adult; (ii) be an emancipated minor; or (iii) have valid parental or legal guardian consent to be bound by these Terms. If you are not an adult or an emancipated minor or do not understand this Clause, please talk to your parents or guardian for assistance. If you are a parent or guardian of a minor creating an account with us, you and the minor accept and agree to be bound by these Terms. You are also responsible for all account usage and compliance with these Terms by the minor, including all purchases made on the account. You may not create or use an account, nor use any of the GamesHyped Services on behalf of another person, natural or legal, or for commercial purposes.
1.2. How can I create an account? (On our website or by creating one within one of our games.)
You can create an account with unique login credentials on our websites or by logging into GamesHyped Services with an existing social network account (if applicable).
1.3. Do I need to provide my real name and other details? (Not required, except for direct payment information on authenticated platforms.)
You must always provide accurate and complete information when requested by our systems.
1.4. I have several different email accounts. Does it matter which one I use to register my account? (Yes. Otherwise, you might miss important notices!)
We send account-related, legal, and service notices to the email address registered to your account. These notifications can be very important (e.g., a notice that we intend to terminate your account due to inactivity), so you should keep the email address associated with your account up to date and (if requested) verified. If you create an account by logging into GamesHyped Services with a social network account, your GamesHyped account email will need to be manually added to our dashboard.
1.5. Can I share or sell my account or login credentials? (No.)
When you create an account with us, we ask you to choose a unique username and password (together, your “Login Credentials”). You agree that:
- 1.5.1. You may not share your account or your Login Credentials with anyone (except in the case of STAFF ASSISTANCE).
- 1.5.2. You may not sell, transfer, or allow anyone else to access your account or Login Credentials, nor offer to do so. You must keep your Login Credentials secret. You must notify us immediately if you become aware of any security breach, including unauthorized account access or loss, theft, or unauthorized use or disclosure of your Login Credentials or payment information, so we can take appropriate action. You are responsible for all losses (including loss or use of Virtual Content) on your account if you have shared your Login Credentials or failed to keep your account or Login Credentials secure.
1.6. Can I request assistance from a STAFF member? (Yes, in some cases.)
Credential requests by a STAFF member are allowed ONLY for requests made via tickets through gameshyped.com or, in some cases, by a STAFF member on the official GamesHyped Discord channel, labeled “GamesHyped” (Role: [STAFF]). Here are the cases where this permission is granted:
- 1.6.1. You cannot resolve your issue via text or video call; your account has bugs or issues affecting only your account;
- 1.6.2. If you authorize the staff to attempt to resolve the issue with your account, you agree to these terms: After support is completed, it is your responsibility to request a password change. If this does not occur and your account experiences issues such as item loss, rank loss, or anything related to your account, there will be no compensation.
2. ACCOUNT TERMINATION
2.1. How can my account be suspended or terminated?
- 2.1.1. You. You may close or suspend your account at any time by contacting us through our support page.
- 2.1.2. Us. We may terminate or suspend your account without notice if it is determined that:
- (a) you violated any part of these Terms (including User Rules);
- (b) doing so is in the best interest of our community or GamesHyped Services or necessary to defend third-party rights;
- (c) we stop offering GamesHyped Services in your region (though we usually post prior notice on our website, app, or game if we plan to discontinue a core game feature or all GamesHyped Services in your region);
- (d) you did not pay any fees owed to us (except in cases of gross negligence or willful misconduct on our part) or we had to refund someone due to unauthorized use of a payment charged to your account; or
- (e) you made (or we have reasonable grounds to suspect you made) unauthorized use of someone else's payment information. We may make these determinations with the help of automated systems and machine learning tools or using other methods we deem appropriate. If you believe we made a mistake, contact us with details, and we will review your case, although we may suspend your account during our review.
2.2. Will GamesHyped keep my account forever, even if I stop using it? (If you abandon your account for too long, we may terminate it after notifying you, giving you an opportunity to reactivate it.)
If you do not use your account for an extended period, GamesHyped reserves the right to take action concerning your account, including suspension or termination. If we intend to take action regarding your account based on prolonged inactivity, you will be notified first (e.g., via email to the address registered to your account) and will have ample opportunity to avoid such actions (e.g., deletion of your account).
2.3. What happens if GamesHyped terminates my account? (You will lose access to your purchases, including Game Currency and Virtual Products.)
If your account is terminated, you will no longer have access to your account, including any associated data or Virtual Content (including Game Currency) (although this does not limit or affect any rights you may have under data protection or consumer protection laws). When we terminate your account for a legitimate reason (e.g., you violated these Terms):
- 2.3.1. You will not be entitled to any refund, and we will have no liability to you; and
- 2.3.2. We reserve the right to cancel any other accounts you may have created and your access to any other GamesHyped Services (also without any refunds or liability to you).
2.4. Can GamesHyped suspend or terminate my account for improper payment use?
If someone requests a refund of a payment charged to your account or made by you, we may review and, in some cases, suspend your account. If we find that the payment was not authorized by the person whose payment information was used, we may take action such as suspending your account until the situation is resolved, or in some cases, we may terminate your account as described in Clause 2.1.2 above. If we refund someone due to unauthorized use of their payment information, you may owe us the amount of that refund.
3. VIRTUAL CONTENT
3.1. What is Virtual Content? (It refers to the content available for use in GamesHyped Services.)
Virtual Content includes any in-game items, currencies, and other digital goods that you may purchase, earn, or otherwise obtain while using the GamesHyped Services. Virtual Content is not physical and has no monetary value.
3.2. Can I buy Virtual Content? (Yes, in exchange for real money or through in-game actions.)
You can obtain Virtual Content by purchasing it with real money or earning it through gameplay and other in-game actions. However, all purchases of Virtual Content are subject to our pricing policies and availability.
3.3. What if I have a problem with my Virtual Content? (You should contact our support team.)
If you experience any issues with your Virtual Content, such as not receiving it after purchase, please contact our support team for assistance. We are here to help resolve any issues.
3.4. Can I transfer or sell my Virtual Content? (No, Virtual Content cannot be transferred or sold.)
You do not own the Virtual Content, and you cannot transfer, sell, or exchange it. Your access to the Virtual Content is licensed, not owned. This license is subject to termination, and you should not expect to have any rights in respect of the Virtual Content after your account is terminated or suspended.
4. USER RULES
4.1. What are the User Rules? (They govern your behavior in the GamesHyped Services.)
The User Rules outline the acceptable behavior expected of all players while using the GamesHyped Services. We take violations of these rules seriously and may take appropriate action, including suspending or terminating accounts.
4.2. What actions are prohibited? (You must not engage in harassment, cheating, or any illegal activities.)
You must not:
- Engage in any form of harassment or abuse towards other players.
- Cheat or use unauthorized software to gain an unfair advantage.
- Engage in any illegal activities while using the GamesHyped Services.
- Use the GamesHyped Services for commercial purposes without our express consent.
- Impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity.
5. REFUND POLICY
5.1. Can I get a refund for my purchases? (Refunds are limited; please read our policy.)
Once you make a purchase and have immediate access to or download the Virtual Content, you lose the right to cancel your order and receive a refund, except where required by law. We may allow refunds under certain circumstances, but these are exceptions rather than the rule. Please review our full refund policy here.
6. AGE RESTRICTIONS
6.1. How old do I need to be to use the GamesHyped Services? (You must be at least 13 years old or have parental consent.)
You must be at least 13 years old to use the GamesHyped Services. If you are under 13, you must have the consent of your parent or legal guardian. If we discover that you do not meet the age requirement, we may terminate your account and all associated data.
7. DISCLAIMERS
7.1. What if something goes wrong? (We are not liable for any losses or damages.)
The GamesHyped Services are provided “as is” and “as available.” We do not warrant that the GamesHyped Services will be uninterrupted or error-free. To the maximum extent permitted by law, we will not be liable for any loss or damage of any kind arising out of or in connection with the use of the GamesHyped Services.
7.2. Are there risks to using the GamesHyped Services? (Yes, including but not limited to technical issues.)
By using the GamesHyped Services, you acknowledge that you understand the potential risks, including but not limited to: technical issues, loss of data, unauthorized access to your account, and other risks that may arise from participation in online gaming.
8. GOVERNING LAW
8.1. What law governs these Terms? (The laws of Brazil apply.)
These Terms are governed by the laws of Brazil, without regard to its conflict of law principles. Any disputes arising from or relating to these Terms will be subject to the exclusive jurisdiction of the courts of Brazil.
9. CHANGES TO THESE TERMS
9.1. Can GamesHyped change these Terms? (Yes, and we will notify you.)
We may modify these Terms from time to time. If we make significant changes, we will notify you via email or through a notice on the GamesHyped Services. Your continued use of the GamesHyped Services after any modifications will constitute your acceptance of the revised Terms.

11. FINAL PROVISIONS
11.1. Entire Agreement (These Terms are the complete agreement between you and GamesHyped.)
These Terms constitute the entire agreement between you and GamesHyped regarding your use of the GamesHyped Services and supersede any prior agreements.
5. TAXAS E IMPOSTOS

Salvo em casos de negligência grave ou dolo por parte da GamesHyped, ou na medida em que estes Termos disponham o contrário, você é totalmente responsável por todas as despesas debitadas em sua conta, inclusive quaisquer despesas não autorizadas.
5.2. Quais são as minhas responsabilidades relacionadas à Moeda do Jogo? (Pagar os impostos incidentes; verificar se todas as transações conosco estão corretas, etc.)
Você é o único responsável pelo pagamento de quaisquer impostos incidentes relacionados à aquisição, ao uso ou ao acesso à Moeda do Jogo. A Moeda do Jogo pode ser vendida ou emitida por nós em pacotes e o preço pode variar dependendo do valor que você compra e de onde está comprando. Conforme acharmos necessário, a nosso critério (ou conforme prescrito por lei), poderemos limitar o valor total da Moeda do Jogo que pode ser comprado para qualquer jogo ou o total de Moeda de Jogo que pode ser mantido em sua conta. Além disso, o preço e a disponibilidade da Moeda do Jogo e dos Produtos Virtuais estão sujeitos a alterações. Poderemos restringir a Moeda do Jogo que você poderá comprar e/ou usar com base em sua localização, pois temos abordagens diferentes em locais diferentes.
5.2.1
Você deve verificar se a quantidade adequada de Moeda do Jogo foi adicionada ou deduzida da sua conta durante qualquer transação. Notifique-nos imediatamente se você acreditar que um erro foi cometido em relação ao seu saldo de Moeda do Jogo. Investigaremos sua reclamação e, ao fazer isso, solicitaremos mais informações para verificação.
6. POLÍTICA DE ENVIO DE IDEIAS NÃO SOLICITADAS
6.1. Posso enviar ideias para melhorar o Jogo à GamesHyped? (Por favor, não. Se você fizer assim mesmo, teremos o direito absoluto de usá-las para sempre.)
Valorizamos seu feedback sobre os Serviços da GamesHyped, mas não envie ideias, sugestões ou materiais criativos para nós (em conjunto, denominadas “Ideias Não Solicitadas”). Poderemos usar livremente qualquer uma dessas Ideias Não Solicitadas que você fornecer. Esta política tem como objetivo evitar possíveis mal-entendidos ou conflitos, caso os Serviços da GamesHyped eventualmente pareçam semelhantes às Ideias Não Solicitadas enviadas pelas pessoas.

Apesar de você não ter direitos legais sobre as Ideias Não Solicitadas que insistir em nos enviar, se o fizer, teremos permissão para usar todas ou algumas de suas Ideias Não Solicitadas por qualquer motivo que escolhermos e sem nenhum pagamento a você.

Em termos jurídicos, isso significa que, se você nos enviar Ideias Não Solicitadas, estará nos concedendo um direito e uma licença mundial, perpétua, irrevogável, sublicenciável, transferível, sujeita a cessão, não-exclusiva, e isenta de royalties, para utilizar, reproduzir, distribuir, adaptar, modificar, traduzir, criar obras derivadas, executar publicamente, exibir publicamente, digitalmente realizar, fazer, mandar fazer, vender, pôr à venda, e importar as suas Ideias Não Solicitadas, inclusive todos os direitos autorais, marcas, segredos comerciais, patentes, projetos, direitos de propriedade industrial, bem como todos os outros direitos de propriedade intelectual e proprietários relacionados, em qualquer mídia atualmente conhecida ou a ser desenvolvida no futuro, para qualquer finalidade, comercial ou outra, inclusive dando as Ideias Não Solicitadas a outras pessoas, sem qualquer indenização para você. Na medida do necessário, você se compromete a assinar e entregar todos e quaisquer documentos e praticar todos e quaisquer atos necessários ou desejáveis a fim de garantir que os direitos de uso das Ideias Não Solicitadas concedidos a nós, conforme especificado acima, sejam válidos, eficazes, e exigíveis, assim renunciando a qualquer reclamação que exija - e prometendo nunca reclamar - o cumprimento de tais direitos na medida máxima do permitido pelas leis de sua região.
7. REGRAS DE USUÁRIO
7.1. Posso ‘trollar’, insultar, ameaçar ou assediar pessoas enquanto estiver usando os Serviços da GamesHyped? (Não. Se você fizer isso, podemos tomar medidas como cancelar sua conta.)
Ao usar os Serviços da GamesHyped, você deve cumprir todas as leis, regras e regulamentos da região em que reside. Você também deve cumprir as políticas de uso e comportamento aceitáveis que publicamos periodicamente em nossos sites, aplicativos e jogos e as regras de comportamento listadas abaixo (em conjunto, denominadas “Regras de Usuário”). As Regras de Usuário publicadas em nossos sites, aplicativos e jogos ou definidas nesta Cláusula não são exaustivas, e a GamesHyped se reserva o direito de modificá-las, bem como tomar medidas disciplinares apropriadas, inclusive banimentos temporários, suspensão, ou encerramento e exclusão da conta a fim de proteger a integridade e o espírito dos Serviços da GamesHyped, independentemente de um comportamento específico estar listado nas Regras de Usuário como inadequado.
7.1.2
A seguir, exemplos de comportamento que justificam medidas disciplinares:
- (a) Fazer-se passar por qualquer pessoa, empresa ou entidade, até mesmo um funcionário da GamesHyped, ou se comunicar de qualquer maneira que pareça que a comunicação se origina da GamesHyped;
- (b) Postar publicamente informações de identificação sobre você, funcionários da GamesHyped ou outros jogadores;
- (c) Assediar, perseguir ou ameaçar outros jogadores ou funcionários da GamesHyped;
- (d) Remover, alterar ou ocultar qualquer aviso de direitos autorais, direitos marcários, patente ou outro aviso de direitos proprietários da GamesHyped contidos nos Serviços da GamesHyped. Você também não pode transmitir conteúdo que viole ou infrinja os direitos de terceiros, inclusive patente, marca, segredo comercial, direitos autorais, direitos de imagem, direitos pessoais ou outros direitos;
- (e) Transmitir ou comunicar qualquer conteúdo que acreditamos razoavelmente ser ofensivo para os jogadores, inclusive linguagem que seja ilegal, prejudicial, ameaçadora, abusiva, assediadora, difamatória, vulgar, obscena, sexualmente explícita ou racialmente, eticamente ou de outra forma condenável;
- (f) Transmitir ou facilitar a transmissão de qualquer conteúdo que contenha vírus, dados corrompidos, cavalo de Troia, bot keystroke logger, worm, time bomb, cancelbot ou outros programas de computador ou códigos que se destinem a danificar e/ou realmente danifiquem, interfiram de maneira prejudicial, e clandestinamente interceptem ou extraiam, anulem ou roubem qualquer sistema, dados ou informações pessoais;
- (g) Evitar, desviar, remover, desativar, prejudicar, decodificar ou de outra forma contornar qualquer medida tecnológica implementada pela GamesHyped ou por qualquer terceiro a fim de proteger ou controlar o acesso aos Serviços da GamesHyped ou qualquer parte deles;
- (h) Enviar spam, seja para fins pessoais ou comerciais, interrompendo o fluxo normal de uma conversa ou poluindo o jogo;
- (i) Fazer múltiplas postagens de conteúdo no mesmo espaço de conversa ou em vários espaços de conversa ou comunidades que são irrelevantes ou fora de contexto;
- (j) Usar qualquer robô, spider, scraper ou outros meios automáticos para acessar os Serviços da GamesHyped para qualquer finalidade sem o nosso consentimento expresso;
- (k) Participar de qualquer ação que possa danificar, desativar, sobrecarregar ou prejudicar os Serviços da GamesHyped;
- (l) Incentivar ou promover qualquer atividade que represente um risco à segurança ou saúde pública, ou que seja contrária à lei, ordem pública ou moral;
- (m) Praticar qualquer outro ato que interfira na experiência de outros jogadores ou que prejudique ou cause danos aos Serviços da GamesHyped;
- (n) Induzir ou convencer outros jogadores a violar as Regras de Usuário.
Se você se envolver em qualquer um desses comportamentos ou em qualquer outro que considerarmos inadequado, podemos, a nosso critério, excluir ou suspender sua conta, independentemente de qualquer aviso prévio. Além disso, podemos divulgar as informações relacionadas à sua conta, incluindo o seu nome, informações de contato, registros de uso, ou quaisquer outras informações que você nos forneceu, a quaisquer autoridades governamentais ou judiciais que solicitem essas informações, em conformidade com as leis aplicáveis.
7.2. Posso fazer parte de um evento ou competição da GamesHyped? (Sim, mas precisamos que você siga algumas regras.)
As Competitions, Torneios e Eventos (“Eventos”) organizados ou patrocinados pela GamesHyped, e a participação em Eventos, estão sujeitos a regras específicas, e você deve seguir essas regras e condições, que podem ser publicadas separadamente. Você reconhece que, ao participar de um Evento, você está se comprometendo a cumprir todas as regras aplicáveis e que a GamesHyped pode determinar sua elegibilidade para participar de um Evento.
7.2.2
A GamesHyped se reserva o direito de alterar, modificar ou cancelar qualquer Evento, a seu critério, e não é responsável por quaisquer danos ou prejuízos que você possa sofrer ao participar de um Evento ou ao não participar de um Evento. Ao participar de um Evento, você concorda em liberar e isentar a GamesHyped de qualquer responsabilidade decorrente do Evento e/ou de sua participação.
8. DIREITOS DE PROPRIEDADE
8.1. De quem é a GamesHyped? (A GamesHyped e seus licenciadores detêm todos os direitos.)
Os Serviços da GamesHyped, incluindo, mas não se limitando a, o design, o conteúdo, os jogos, a Moeda do Jogo, o software e as ferramentas de jogos, são propriedade da GamesHyped ou de seus licenciadores e estão protegidos por leis de direitos autorais, marcas, segredos comerciais e outras leis de propriedade intelectual. Você não adquire, por meio destes Termos ou de seu uso dos Serviços da GamesHyped, nenhum direito sobre a propriedade intelectual, propriedade ou ativos da GamesHyped.
8.1.2
Você concorda que a GamesHyped pode incluir informações sobre você ou seu uso dos Serviços da GamesHyped em relatórios de conformidade e no mercado, bem como utilizar os dados gerados a partir de seu uso para fins de pesquisa, análise e outros usos comerciais, e você não terá direito a qualquer compensação por isso.
9. MODIFICAÇÕES DOS SERVIÇOS
9.1. A GamesHyped pode alterar os Serviços? (Sim.)
Você concorda que a GamesHyped pode, a qualquer momento e a seu exclusivo critério, modificar, alterar ou descontinuar qualquer parte dos Serviços da GamesHyped, inclusive quaisquer produtos, conteúdo ou funcionalidades, ou criar novas funcionalidades ou serviços, com ou sem aviso prévio. Ocasionalmente, podemos também disponibilizar funcionalidades de pré-lançamento para que você teste antes do lançamento oficial. Você reconhece e concorda que a GamesHyped não terá nenhuma responsabilidade por quaisquer modificações, interrupções ou descontinuações de qualquer parte dos Serviços da GamesHyped.
9.2. O que acontece se eu não gostar das mudanças feitas pela GamesHyped? (Você pode cancelar sua conta.)
Se você não concordar com qualquer modificação nos Serviços da GamesHyped, sua única e exclusiva solução será cancelar sua conta, conforme indicado na Cláusula 2 (Encerramento da Conta) acima. Você deve estar ciente de que a GamesHyped pode ter que fazer alterações aos Serviços da GamesHyped para cumprir as leis ou regulamentos aplicáveis, e que você concorda em obedecer a quaisquer novas regras ou regulamentos.
13. WARRANTY DISCLAIMER
13.1. Does GamesHyped offer any warranties regarding the GamesHyped Services?
(Depends on where you are -- brace yourself for more lawyers yelling!) You assume all responsibility for the installation and use, as well as the results obtained from the GamesHyped Services (no matter where you are located).
13.1.2 Furthermore, if you are located in North, Central, or South America:
- (a) The GamesHyped Services are provided to you "as is" and "as available," without warranties or representations of any kind, express or implied. You assume full responsibility for any use you make of the GamesHyped Services. To the maximum extent permitted by applicable law, GamesHyped disclaims all warranties, express or implied, that may apply to the GamesHyped Services, including implied warranties of title, non-infringement, merchantability, fitness for a particular purpose, and any warranties arising from course of dealing, performance, or usage of trade, as well as any warranties regarding the accuracy, reliability, or quality of any content or information contained in the GamesHyped Services.
14. INDEMNIFICATION
14.1. If someone sues GamesHyped based on my use or misuse of the GamesHyped Services, do I have to pay for GamesHyped's legal expenses?
(Yes.) To the extent permitted by law, except in cases involving our gross negligence or willful misconduct, you hereby agree to indemnify, defend, and hold harmless GamesHyped, as well as its subsidiaries, affiliates, directors, and officers, from and against all claims, actions, losses, liabilities, and costs arising from or resulting from your misuse of the GamesHyped Services, any violation of any provision of these Terms (e.g., if you use hacks, cheats, or bots in the GamesHyped Services or infringe our IP rights), or any violation of the rights of third parties committed by you. GamesHyped reserves the right to, at its own expense and in its sole and absolute discretion, assume exclusive control of the defense and settlement of any matter for which you are required to indemnify us; in which case you will cooperate with GamesHyped in asserting any available defenses.
For example, if you use the GamesHyped Services as part of a business operation (something you do not have permission to do) and we are sued for something you do that breaches these Terms, you must defend us in court and pay for any damages we incur.
15. LIMITATION OF LIABILITY
15.1. Is there a limit to GamesHyped's potential liability under these Terms?
(Yes.)
15.1.2 To the extent permitted by law, our total liability to you (whether for breach of contract, negligence, or any other reason) for any loss, injury, or damage suffered by you in connection with downloading, using, and/or accessing the GamesHyped Services is limited to the total amounts paid by you to GamesHyped during the 6 (six) months immediately preceding the time your cause of action first arose.
15.1.3 We provide the GamesHyped Services for domestic and private use only.
We are not liable for business losses (such as loss of profits, loss of business, business interruption, loss of goodwill, or loss of business opportunity). We are also not liable for any damage that occurs because you do not install any updates when they are made available by GamesHyped or when you fail to maintain the minimum system specifications required. Separately, we are not responsible for:
- (i) any loss that was not foreseeable at the time you accepted these Terms; or
- (ii) any loss that we both knew could occur only due to your special circumstances existing at the time you accepted these Terms (including all indirect damages).
15.1.4 Notwithstanding any contrary provision in these Terms, WE DO NOT EXCLUDE OR LIMIT, IN ANY WAY, OUR LIABILITY TO YOU WHEN IT WOULD BE ILLEGAL TO DO SO, including our liability for:
- (i) death or personal injury resulting from our negligence;
- (ii) fraud or fraudulent misrepresentation by us;
- (iii) negligent or willful misconduct;
- (iv) damages arising from a negligent breach of a duty that is essential to the performance of the contract by GamesHyped (“Essential Duties”) to the extent that it is typical and foreseeable;
- (v) any warranty given by us to you; or
- (vi) any liability under applicable law regarding product liability in a region.
You may also have specific rights under local law in addition to those described above.
16. GOVERNING LAW
16.1. What law applies to these Terms or in the event of a dispute?
(This depends on where you live and which GamesHyped company provides the GamesHyped Services to you.) Read below to determine which laws apply to your use of the GamesHyped Services. Regardless of which governing law applies, you may benefit from the application of other rights or mandatory rights or measures provided under local law, in addition to those established in these Terms. Nothing in these Terms limits or affects those rights.
16.1.2 If you live in North, Central, or South America (except Brazil)
(a) These Terms and any action arising from or in connection with these Terms will be governed by the Federal Arbitration Act and the laws of the State of California, without regard to its conflict of laws provisions.
16.1.3 If you live in South Korea
(a) These Terms and any action arising from or relating to these Terms will be governed by the laws of South Korea.
16.1.4 If you live in Japan
(a) These Terms and any action arising from or relating to these Terms will be governed by the laws of Japan.
16.1.5 If you live in Singapore, the Philippines, Thailand, Malaysia, Indonesia, and Cambodia ("Southeast Asia")
These Terms and any action arising from or relating to these Terms will be governed by the laws of Singapore.
16.1.6 If you live in the European Economic Area, the United Kingdom, Brazil, or any country not listed in this Clause 16
These Terms and any action arising from or relating to these Terms will be governed and interpreted according to the laws of Ireland, without regard to the principles of conflict of laws in the jurisdiction.
17. ADDITIONAL TERMS APPLICABLE TO THE GamesHyped SERVICES
17.1. General Terms
17.1.2 You may access the GamesHyped Services that we provide from certain authorized third-party stores or platforms (a third-party provider of any store, gaming system, console, or platform, individually referred to as a "Third-Party Platform"), only if you agree that:
- (a) These Terms are an agreement between us and you, and not between you and the Third-Party Platform. Between GamesHyped and the Third-Party Platform, GamesHyped is solely responsible for any GamesHyped Services.
- (b) The Third-Party Platform has no obligation to provide maintenance and support services for the GamesHyped Services.
- (c) The Third-Party Platform is not responsible for addressing any claims you may have related to the GamesHyped Services or your possession and use of the GamesHyped Service.
- (d) If a third party alleges that any of the GamesHyped Services infringes the intellectual property rights of another party, as between the Third-Party Platform and GamesHyped, the Third-Party Platform will not be responsible for investigating, defending, settling, or discharging any claim.
- (e) GamesHyped and the Third-Party Platform may, in certain circumstances, conduct investigations, evaluate, and defend against allegations that may arise from your use of the GamesHyped Services.
